REWARDS CLUB TERMS & CONDITIONS

1. Membership & Eligibility Russell Stover Rewards Club ("Program") is a free rewards program offered by Russell Stover Chocolates, LLC (“Russell Stover”) to customers located in the United States. Membership to the Program ("Membership") is limited to individuals only and is limited to one account per individual. Employees and representatives of Russell Stover and its affiliates are not eligible for Membership. Customers must be age 18 years or older and a legal resident of the United States to be eligible for Membership. Membership to the Program requires Customers to provide valid email address and phone number.
   BY SUBMITTING AN APPLICATION FOR MEMBERSHIP IN THE PROGRAM, YOU AGREE TO THESE TERMS AND CONDITIONS ("TERMS").
2. Earning and Redeeming Program Rewards Purchases are necessary to earn Program points as well as receive Program Rewards, offers, coupons, discounts, or any other benefits from the Program ("Program Offers"). Russell Stover Rewards Club Points, Rewards, offers, coupons, discounts, or other benefits are non-transferable. Coupons and rewards have expiration dates. Rewards may not be redeemed after the expiration dates. Points never expire. Lost or stolen coupons or offers will not be replaced. Without limiting the foregoing, Russell Stover Chocolates is not responsible for coupons or other offers lost in the mail.
3. Changes, Termination and/or Removal from Program Russell Stover Chocolates may, in its sole discretion, at any time and without prior notification, alter or limit the Program and/or Program Offers, or otherwise change the Program rules, terms, and conditions, Programs Offers and restrictions, or terminate the Program entirely. The Program participant ("Participant") agrees to forfeit any unredeemed Program Offers upon termination of the Program. Russell Stover Chocolates may void participation in the Program if the Participant, at Russell Stover Chocolates' sole discretion, engages in fraud, deception, forgery or other abuses of the Program, or for any other reason. The Program, and the Participant's participation therein, is subject to these Terms and Conditions as well as other terms, conditions, rules, policies and limitations as Russell Stover Chocolates may from time to time designate (including, without limitation, any applicable Program terms and conditions which Russell Stover Chocolates may include on its website at www.russellstover.com). Any necessary interpretation or application of these Terms and Conditions or policies related thereto shall be made by Russell Stover Chocolates at its sole discretion. If a Participant objects to any changes to the Program, the Participant's sole recourse shall be to cease participating in the Program. Participant's continuing participation in the Program constitutes conclusive evidence of the Participant's agreement to such change(s).
4. Communications from Russell StoverBy becoming a Participant in the Program, Participant agrees to receive advertising, marketing materials and other communications from Russell Stover Chocolates. The information Participant provides will be handled in accordance with Russell Stover Chocolates privacy policy. To view the privacy policy visit russellstover.com. If you do not wish to receive these communications, you can request that they be discontinued by updating your Member Account profile, by emailing Customer Service at customerservice@russellstover.com or by calling our customer care team at 1-800-777-4028. 5. Limitation of LiabilityTO THE FULLEST EXTENT PERMITTED BY LAW, RUSSELL STOVER AND/OR ITS PARENTS; SUBSIDIARIES; AFFILIATES; OPERATORS, MEMBERS, DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, INSURERS, AND ALL RELATED OR AFFILIATED PERSONS OR ENTITIES (THE “COMPANY”) WILL NOT BE LIABLE FOR ANY DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR PARTICIPATION OR MEMBERSHIP IN THE PROGRAM, INCLUDING DAMAGES ARISING OUT OF CHANGES TO OR TERMINATION OF THE PROGRAM. THIS IS A COMPREHENSIVE LIMITATION OF LIABILITY THAT APPLIES TO ALL DAMAGES OF ANY KIND, INCLUDING BUT NOT LIMITED TO DIRECT, INDIRECT, INCIDENTAL, PUNITIVE OR CONSEQUENTIAL DAMAGES, LOSS OF DATA, INCOME OR PROFIT, LOSS OF OR DAMAGE TO PROPERTY AND CLAIMS OF THIRD PARTIES. TO THE EXTENT PERMITTED BY LAW, THE LIMITATIONS ON THE COMPANYRUSSELL STOVER'S LIABILITY SET FORTH HEREIN SHALL APPLY WHETHER FOR BREACH OR REPUDIATION OF CONTRACT, OR WHETHER IN TORT, CIVIL LIABILITY BY WAY OF NEGLIGENCE, GROSS NEGLIGENCE, STRICT LIABILITY, OR OTHERWISE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGE. BY AGREEING TO THESE TERMS, YOU WILLINGLY AGREE THAT YOU HAVE RELINQUISHED YOUR RIGHT TO SEEK THESE DAMAGES FROM RUSSELL STOVERTHE COMPANY AND THAT THIS IS A REASONABLE ALLOCATION OF RISK.
6. Program Materials and ContentAll Program materials, visual content and arrangement thereof are property of Russell Stover Chocolates, LLC. The collection, arrangement and assembly of all Program data is the exclusive property of Russell Stover. Unless otherwise indicated on a particular part of the Program materials, permission is granted to electronically copy and to print in hard copy portions of the Program materials for the sole purpose of accessing the Program and the services provided therein for personal use. Any other use of Program materials - including but not limited to reproduction, modification, or distribution without the prior written permission of Russell Stover is strictly prohibited.
7. Trademarks www.russellstover.com and all page headers, custom graphics and button icons are service marks, trademarks, and/or trade dress of Russell Stover and may not be used in connection with any product or service that is not offered by Russell Stover in any manner that is likely to cause confusion among customers, or in any manner that disparages or discredits Russell Stover. All other trademarks, product names and company names or logos cited herein are the property of their respective owners.
